In other Malawi adoption news, David Banda was allowed to visit with his biological father while visiting Malawi this week. Banda seemed not to know who the man was at first, but warmed up to him quickly. While speaking to his father, the little boy expressed that he missed his adopted father, Guy Ritchie, very much.
While there, David was able to visit with his biological father Yohane Banda, but the tot didn’t know who he was.
David and Yohane spent about three hours together - it was the first time since 2006 - but the little boy didn’t recognize his bio father. Yohane was stunned that David didn’t know who he was or that he couldn’t speak his native language.
Yohane said, “He asked me in English who I was and what I do. When I told him, ‘I am your daddy’ he looked surprised. We spent three hours together… he played with my nose and although he did not know who I was he asked me lots of questions.
“David is quite chatty and intelligent. He asked whether I ride horses but I told him horses are for the rich. He asked me why I am poor. He said his mum likes riding horses and told me that one day he and his brother, Rocco, rode horses and fell. He said his mum spanked him because they are not supposed to ride on their own.”
David also told Yohane he misses his nanny, who quit (or fired by Madonna… whichever rumor you believe). “He misses her a lot because she used to read him books. Nowadays he has different nannies and he doesn’t like the situation.”
The three-year-old spoke of his relationship with Guy Ritchie.
“He seems to like his daddy Mr. Ritchie so much,” said Yohana. “I was a sad Madonna broke up with him. I would have loved it if they sorted out whatever problems they had instead of divorcing because divorce is bad for kids.”

Wow! That’s a lot of very interesting information. First, who would have thought that Madonna would spank her kids? Isn’t she supposed to be so spiritual and peaceful and non-violent thanks to Kabbalah? And also, wouldn’t you think she’d just get the nanny to do it? And speaking of nannies - it’s quite telling that the two people David misses are his nanny and Guy Ritchie. Before the divorce, these were probably the two people he saw the most. It’s also interesting that Madonna has made absolutely no effort to teach David anything about the country he came from, or to give the child any background on himself. He didn’t even know his own father, and he didn’t understand why his father was poor.

Madonna?s lawyer is laying down the law. Alan Chinula is representing Madge for the adoption of Mercy James. The final decision will be rendered by a Malawian judge on Friday, most likely. But to Chinula, there are no worries. He says ?I don’t see any law in Malawi that can stop this adoption? and that Mercy?s uncle ?has already signed off the consent forms, and Madonna counter-signed them.? So I guess that?s that. Why even show up for the Friday court date?
Madonna’s lawyer Alan Chinula tells Usmagazine.com he is confident that the judge will allow the singer, 50, to adopt 4-year-old girl Chifundo “Mercy” James at Friday’s hearing.
“I am not sleeping sleepless nights over this,” Chinula tells Us. “I don’t see any law in Malawi that can stop this adoption.”
On Tuesday, a rep for Madonna confirmed for the first time that the singer is adopting the girl, whose unwed 18-year-old mother died soon after she gave birth. Chinula tells Us the girl’s uncle, Peter Baneti, “has already signed off the consent forms, and Madonna counter-signed them.”
“She just has to wait to hear from me when I get the result” on Friday, he says. She is not required to attend the hearing, Chinula adds, “although she can attend if she so chooses.”
Several non-governmental organizations have called the Human Rights Consultative Committee, slamming Madonna’s adoption attempt because the groups feel the child should be taken care of by her own family.
The organizations also accuse the singer of using her wealth and celebrity status to bend Malawi’s adoption laws. (The singer, who adopted David Banda in 2006, has not followed regulations that stipulate that prospective parents must undergo an 18- to 24-month assessment period in Malawi before adopting.)
But Chinula tells Us that law is over 50 years old and “archaic.”
“Laws must be dynamic,” he says. “They must move with current trends.”

There are several daily updates happening on Madonna throughout the week. Some of them are just tabloid ?reports? coming from people who have literally nothing to do with Madonna, Mercy or Malawi. But some stories are interesting, like this one from The Telegraph. Apparently Madge had been e-mailing her friends about the adoption. One of these friends, Ben Fellows, released Madge?s e-mail to The Daily Mirror (although this story is via The Telegraph). Madge told Fellows that she was ?going to jump through hoops to get [Mercy]?. Madge also wrote ?Let the storm commence.? It?s commencing, Gristle. You don?t have to beg for it quite so much.
[In] an email to her friend Ben Fellows, a British film-maker, she said that the criticism over her plans would not stop the adoption, adding: “Let the storm commence”.
Mr Fellows, who was himself adopted, told the Daily Mirror: “Once Madonna has put her mind to something, she achieves it - and this adoption is no different.?
“She told me she thought it was very important that David had a sister, she had unconditional love to give another child and was going to jump through hoops to get her.?
“She knew exactly what she was walking into. She was well aware that people would start sniping about it. She sent me an email just before she left for Malawi and signed it off ‘Let the storm commence!’”

Here?s what I don?t get - why does Madonna drown us in sanctimony about all of her latest issues, when her goal was and is solely to get publicity? If she really wants the attention so badly (and I think by now it?s clear that she does), why pull the bait and switch after the fact? Perhaps I?m not explaining my point very well, so let me take a step back.
Part of the problem I had with Madonna after David Banda?s adoption was that she went on Oprah and defended herself and her actions in a very sanctimonious, holier-than-thou way. She basically said that all she cared about was adopting a needy child, and that nothing else mattered to her. But clearly, all of the publicity and media exposure means a lot to her too, or else she would try to act in a quieter (legal) way that would benefit her children, or the children she?s trying to adopt.
It just feels like she saw all of the attention (so much of it negative) that she got with David Banda?s adoption, and is really trying to willfully mimic so many of the same mistakes with Mercy?s adoption. Her attitude is cavalier, craven and desperate.

Back in February of last year, Madonna managed to raise an estimated $3.7 million for her Raising Malawi charity. An impressive amount which could help the impoverished country. Now, 14 months later, the money is still unaccounted for despite many attempts to ascertain where it went.
The fundraiser had some problems, however. Even though Raising Malawi had been in business for two years, it was still not approved as a sanctioned non-profit at the time. Instead, Gucci formed its own Foundation ? known as a 501 c3 ? to collect the money. They brought UNICEF on board to give the event a feeling of legitimacy. But in the end, the efforts expended were for Raising Malawi, an organization founded by the Kabbalah Center of Los Angeles. Raising Malawi teaches the Kabbalah curriculum, called Spirituality for Kids, to Malawi orphans.
Now, fourteen months after the fundraiser, there?s no accounting for the money that came in. At the time, Gucci claimed that they?d underwritten the entire event, that $3.7 million had been raised and that it had been split between Raising Malawi and UNICEF.
But since then, the Gucci Foundation has still not filed a Form 990 tax statement, and neither has Raising Malawi. Calls to Gucci haven?t provided any information, and calls and emails to Raising Malawi haven?t been returned.
Clearly the $3.7 million has already gone to help poor Malawians. Malawians by the name of David who live in Madonna’s house. David, once living in poverty, now has a gigantic diamond ring sized for Madonna’s finger and a bunch of designer purses which he can use in high school if he so chooses. That David sure is lucky.

Madonna has confirmed to media outlets that she is in Malawi to adopt Mercy James, and that she hopes the Friday court hearing will go her way. Madonna?s tireless publicist Liz Rosenberg also confirmed the meeting between David Banda and his biological father, saying, ?Madonna is committed to maintaining an ongoing relationship with David’s Malawian roots.?
The Associated Press has the information on where the adoption case stands now, as well as information about the current protestations of the adoption. A coalition of Malawian non-governmental child-advocate groups called ?Mwakusungula? has spoken out against Madonna’s adoption of a child with multiple living relatives. The AP has more:
Madonna has confirmed her attempts to adopt a young Malawian girl and said through a spokeswoman that she is following standard procedures in adopting the child amid criticism by some that she was using her fame to quicken the process.
The 50-year-old pop superstar also confirmed she took her 3-year-old son David, also adopted from Malawi, to visit with his biological father Yohane Banda for the first time since she and David left the country in 2006.
“Madonna is committed to maintaining an ongoing relationship with David’s Malawian roots,” said Liz Rosenberg in a statement Tuesday morning.
In her statement, Madonna confirmed she is trying to adopt a girl named Chifundo “Mercy” James who is about 4 years old. Malawian welfare official and another person involved in the proceedings had confirmed an adoption application was under way and spoke on condition of anonymity because the case is considered sensitive.
The girl’s 18-year-old mother was unmarried and died soon after she gave birth, according to the child’s uncle, John Ngalande. Her father is believed to be alive but has little contact with his daughter, he said.
A coalition of non-governmental organizations called Mwakusungula have criticized Madonna’s adoption attempts, saying that adoption should be the last resort and that children need to be taken care of by their own family.
“Mercy James is a child who has her extended close family members alive and we urge Madonna to assist the child from right here,” a statement from the coalition said.
But others have said that the adoption would give enormous opportunities to the child that she would be unable to achieve in the impoverished African nation. Malawian law is fuzzy on foreign adoptions. Regulations stipulate only that prospective parents undergo an 18- to 24-month assessment period in Malawi, a rule bent when Madonna was allowed to take David to London.
Madonna may also face challenges as a single mother; she divorced Guy Ritchie last year.
Madonna first traveled to Malawi in 2006 while filming a documentary on the devastating poverty and AIDS crisis. Her Raising Malawi organization, founded in 2006, raises funds to provide food, shelter, education and health care for children.

As it turns out, Fox News was one of the news outlets who wondered what exactly is happening with Raising Malawi and all of those millions of dollars Madonna has allegedly given and raised. I gave Madonna the benefit of the doubt last week, because I really want to believe that despite it all, The Gristle is a good mother who loves her kids. But I can?t turn my back on all of this controversy. What makes it worse (in my mind) is that Madonna seems to be actively courting these controversies. She seems to thrive on them, like, how could she try to adopt a child or hold a fundraiser without screwing it up so badly? How hard is it to hire a tax attorney to get your charity a non-profit status? How hard is it to follow adoption procedures?

Madonna has come under a lot of well-deserved fire for jetting into poverty-striken Malawai with the intention of adopting a little girl, Mercy, who has a living grandmother who was hoping her granddaughter could stay in the country. If the adoption goes through this will be the second time Madonna has flouted Malawian adoption laws, which require adoptive parents to stay in the country for 18 months. In 2006 she adopted David Banda, who has a living father who could not afford to keep him. Madonna is starting schools, funding orphanges, and helping Malawai monetarily, but does that mean that she can leave with a child despite the objections of their family and the fact that she’s breaking the law?
The Huffington Post points out a minor detail that seems to highlight the glaring issues of class disparity in this case. Madonna wore a Chanel sweatsuit to tour an impoverished school in Malawi. The sweatsuit was worth $2,800, more than ten times the average yearly income in the nation:
Madonna arrived in Malawi Sunday morning on her Gulfstream V in her bid to adopt a toddler girl named Mercy.
After arriving she toured an impoverished school but refused to talk to reporters. She was, in the words of the AP, “dressed casually” in a black velour tracksuit and white fedora. But that casual look costs about $2,800.
A look at the photos shows her dressed-down attire is a Chanel tracksuit, tone-on-tone labels blazing from her shoulder and the stripes down her leg. Huffington Post placed a call to the 57th Street store in New York Monday with a casual inquiry, and a helpful saleswoman priced a similar ensemble at $2,800.
A zip front jacket is $1,600 and the pants about $1,200. A cheaper alternative to the one Madonna wore in Malawi is the $1,200 pullover jacket. Currently the store is stocking the velour in gray. They also have the tracksuit in cashmere for several hundred dollars more. Chanel clothing is not available online.

Of course Madonna can wear whatever she wants, and she’s rich so she’s entitled to buy a sweatsuit worth enough to supply water to several villages. There are two schools of thought on this adoption. One is that Madonna is bringing awareness to the conditions in Malawi, that she’s spending money to ensure that things change, and that little Mercy will have a comfortable, privileged life with her and opportunities that she could never dream of if she stayed in Malawi. The other side is that Madonna is so insulated from the realities of the world that she thinks that she is just as entitled to a child with living family as she is to an insanely overpriced outfit.
Mercy is now staying with Madonna her three children and a nanny in a luxury lounge outside Lilongwe. David Banda, 4, saw his biological father for the first time in perhaps three years yesterday. David’s father told the press that Madonna canceled a scheduled meeting with him during another visit to Malawai two years ago, although some reports have him meeting David briefly at the time. The judge ruling on Mercy’s adoption has postponed her decision until Friday, but it’s easy to predict that Madonna will get her way. She usually does.

Madonna arrived in Malawi Sunday evening for a week-long stay which she hopes will lead to her adoption of three-year-old Mercy James (who is perhaps four years old, the reports keep changing). Earlier last week, it seemed as if Madonna was going to pull off her second Malawian adoption with much less fanfare and criticism than her first adoption of David Banda. Unfortunately for all involved, scandal, criticism and the media glare follow every decision Madonna makes.
Almost simultaneously, the grandmother of Mercy James and international children?s advocacy groups slammed Madonna for her attempted adoption of Mercy. Initial reports claimed that Mercy was in fact an orphan, that Mercy?s mother had died within days of Mercy?s birth, and that Mercy?s father had died of AIDS. Mercy?s uncle will be attending Monday?s court hearing, and basically signing Mercy over to Madonna, but the child’s grandmother is putting up a fight. The grandmother, Lucy Chekechiwa, claims she will resist Madonna?s efforts, and that Madonna is trying to ?steal? her granddaughter, who was supposed to be released to her care at the age of six:
Mercy was placed in the orphanage after her 18-year-old mother died days after her birth and her father died of Aids.
However the girl’s grandmother Lucy Chekechiwa, 61, has said she will resist the move and claims an agreement with the orphanage means she will keep Mercy once she turns six.
She told The Sun newspaper: “Why doesn’t this singer pick other children? It is stealing. I want to go to court, I won’t let her go.”
She added: “They told me when I visited her last month that they want to find a better education and home for Mercy. But I am sticking to the initial agreement that Mercy will return home to me after she reaches six years old.”

The Telegraph is now reporting the rumor that Mercy?s father might still be alive. Much like David Banda?s father, who has reportedly gone to the Malawi lodge where Madonna is staying so that he can visit his son.
Advocates from Save the Children are also pitching a major fit over this whole situation. Their official policy is to exhaust all options within the home country, even encouraging extended families to care for orphaned children, rather than giving children away to orphanages. A spokesperson for Save the Children says, ?We urge any celebrity to set an example, to follow internationally agreed procedures designed to protect the child, and to ensure that the child in question has no other options in their home community.? Officials at the airport in the nation’s capital Lilongwe said Madonna arrived late on Sunday.
“She disembarked from the cargo area and jumped into her convoy,” an airport official said. The luxury lodge where Madonna has stayed in the past has been fully booked and casual visitors have been turned away. An employee said Madonna had checked into the exclusive lodge, accompanied by her son David Banda, whom she adopted in 2006 from the same Mchinji Home of Hope orphanage where four-year-old Mercy lives.
The employee, who did not want to be named, said David’s biological father Yohane Banda was at the lodge to see his son.
Children’s charity Save the Children has urged the singer to think again although the family of the toddler she is seeking to remove from the impoverished African republic is now said to be supporting the adoption.
Questions were asked after she and then-husband Guy Ritchie took David Banda to their London home in 2006 while the child was 13 months old, and her latest quest for a sister for David has led to renewed criticism.
Mercy’s grandmother Lucy Chekechiwa, 61, initially hit out at the star, telling tabloid newspapers: “It is stealing. I won’t let her go.” Mrs Chekechiwa claimed it had been agreed the child would go to her when she turned six. Mercy’s father is believed to be alive but no other details were available from a welfare official and people close to the case who today said the girl’s relatives have now consented to the adoption. Madonna and the girl’s uncle are expected to appear in court today to sign adoption papers.
Austin Msowoya, legal researcher with Malawi’s Law Commission, played down concerns saying the best interests of the child needed to be taken into account - whether this was staying in an orphanage in Malawi or getting “an education with Madonna”.
“When you look at these two options, then perhaps it becomes in the best interests of the child to allow the adoption if the parents and the guardians consent to it,” he said.
Meanwhile, Save the Children said orphans should be cared for by extended family in their home country and suggested international adoption can make matters worse. Spokesman Dominic Nutt said: “The best place for a child is in his or her family in their home community. Most children in orphanages have one parent still living, or have an extended family that can care for them in the absence of their parents.”
According to Save the Children, international adoption should only be considered if the child is a genuine orphan, and if all other alternatives in their own country have been genuinely exhausted.
“International adoption can actually exacerbate the problem it hopes to solve,” said Mr Nutt. “The very existence of orphanages encourages poor parents to abandon children in the hope that they will have a better life.”
Mr Nutt also said international adoption can mean big business in some countries, with “unscrupulous” adoption agencies profiting from the sale of children. He said: “We urge any celebrity to set an example, to follow internationally agreed procedures designed to protect the child, and to ensure that the child in question has no other options in their home community.”
Madonna’s spokeswoman Liz Rosenberg, who has not commented on the adoption reports, said the star would not respond to Save the Children.

I totally understand why these Save the Children advocates are getting so riled up, but they might want to think about spreading the blame around - Madonna wouldn?t be able to go in and have a baby hand-delivered to her if the Malawian adoption system wasn?t so screwed up. The Malawian legal system is basically telling the world that they?re open for the baby-selling business if the celebrity is big enough and the money she spreads around is enough.

The rumors are true; Madonna is set to adpot another Malawian child. Maybe that brand of kid suits her tastebuds or something. Digital Spy reports,
A four-year-old girl in Malawi named Mercy James has been taken to a luxury lodge to prepare her for adoption by Madonna, it has been claimed.
The pop superstar is expected to visit the country this weekend after she filed adoption papers there, the Daily Mail reports.
A source said: “Mercy has been handed over to Madonna’s people, who are already at the lodge, and is being cared for by a nanny.
“They are waiting for Madonna to arrive so mother and daughter can be united and then Madonna is expected to take Mercy with her when she leaves.”
The child had been living at an orphanage near Blantyre in southern Malawi and was moved to Kumbali Lodge near Lilongwe.
I hear she’s being ceremonially washed in the waters of a natural spring, then dressed in a beautiful silk sarong. Then her hair will being brushed with fragrant oils and artfully arranged, and adorned with orchids. A little tranquilizer will be added to her milk so she won’t struggle when the feast begins. It?s seems as if Madonna really will be adopting the little four-year-old Malawian girl Mercy James. It was officially announced and confirmed by Madonna?s people and by people within the Malawi government that Madonna has filed much of the paperwork for another adoption, and will be picking her daughter very soon. Madonna has tried to adopt this girl for the past two years, ever since David Banda?s adoption was finalized.
Now The Daily Mail is reporting that Madonna is flying to Malawi this weekend, and she will stay in-country for a week. Madonna hopes to leave Malawi with Mercy in hand, so to speak. However, there will likely be some controversy, and maybe even some legal problems, as Malawi?s adoption system is rather poorly run, and Madonna tends to appear to be ?hijacking? Malawian babies.
Madonna is finally due to adopt the little girl she has wanted for nearly two years when she flies into Malawi this weekend.
Four-year-old Mercy James was taken to a luxury lodge outside Lilongwe earlier this week, in preparation for being united with the singer, according to sources.
Madonna, 50, is expected to stay in the south-east African country for a week before flying out with Mercy - bar any last-minute hitches.
The girl is being cared for by a nanny at Kumbali Lodge - where Madonna has stayed on her previous visits to the country. She had been living at an orphanage near Blantyre, in the south of Malawi.
Madonna had hoped to keep the fact that the child is already at the lodge a secret until leaving the country.
‘Mercy has been handed over to Madonna’s people, who are already at the lodge, and is being cared for by a nanny,’ says the source. ‘They are waiting for Madonna to arrive so mother and daughter can be united and then Madonna is expected to take Mercy with her when she leaves.’
Madonna is expected to bring three-year-old David Banda - whom she adopted in Malawi in 2006 - with her to meet his new sister. The Lodge has been booked out from March 26 to April 4.
On Monday, the singer is expected to attend a court hearing in Lilongwe to formalise the adoption after having reportedly filed adoption papers. If the judge refuses to rubber stamp the adoption, however, it will be a severe embarrassment to Madonna, now that Mercy is in the care of her staff. The adoption of Mercy is likely to be every bit as controversial as that of David Banda in 2006.
After Madonna’s divorce from Guy Ritchie last November, Malawian adoption official, Penston Kilembe, reportedly said: ‘One fundamental condition in scrutinising adoptions is the connectedness of a family.

?’Mercy has been handed over to Madonna’s people, who are already at the lodge, and is being cared for by a nanny.? That sentence gave me a little shiver. Like Mercy was a Brikin bag that Madonna ordered, and was awaiting delivery at a hotel. Yikes.
Some commenters had issues with my statement yesterday that I don?t really think Madonna is a bad mother. I don?t think she?s mean or intolerant or abusive, and I really do think Madonna loves her children. I think she?ll probably provide David Banda and Mercy James good lives, with more opportunities than they would get anywhere else.
Is that enough? Probably not. Because even with the opportunities Madonna can and will give a needy child, the whole situation still makes me very uncomfortable. Some of it isn?t Madonna?s fault - the Malawi government should treat all prospective adoptive parents the same way, regardless of celebrity. Madonna’s affairs with 22-year-old Brazilian model Jesus Luz and whoremonger Alex Rodriguez may have squelched any chances of her adopting another child from Malawi. According to the NY Daily News
A senior official from Malawi’s Ministry of Women and Child Welfare Development… said morality plays a big part in the adoption process [in Malawi].
He said, “Madonna’s relationships may negatively affect the adoption of [ 3-year-old Mercy James]. The news she is linked to another woman’s husband and a young man less than half her age makes us question her morals.”
Well, I’m glad something finally tipped them off that Madonna wasn’t exactly a saint. You’d think the book of Sex pictures and the Penthouse spread might have sent up a few red flags before, but remember, this is Africa we’re talking about. I’m pretty sure the printed word is still a myth over there, much like functioning democracy and condoms.

Madonna is considering adopting another child. And no, not Jesus Luz. Madonna gave an e-mail interview to Malawi?s Nation newspaper, and she says that she?s considering adopting another child from the country. Her son David Banda, now three and a half, was adopted from Malawi in 2006, though the legal wrangling for the adoption took more than a year.
Madge puts conditions on the adoption she?s considering, however. She says that she would only go ahead ?if I had the support of the Malawian people and the Government.” We?ll see about that. Star has more:
No daddy? No problem! Newly divorced Madonna says she may adopt another child from Malawi ? despite the controversy surrounding her earlier adoption of young David Banda.
“Many people, especially our Malawian friends, say that David should have a Malawian brother or sister,” Madge said in an email interview in Malawi’s Nation newspaper. “It’s something I have been considering, but would only do, if I had the support of the Malawian people and the Government.”
In 2006, Madonna began adoption proceedings for then 13-month-old David, whose father put him in an orphanage following the death of his wife. Malawi previously banned non-residents from adopting ? despite having an estimated one million children in the country orphaned by AIDS.
A Malawian court approved the adoption of David last year. Madonna added that she wants to keep her son ? who has older siblings Rocco, 8, and Lourdes, 12 ? connected to his homeland.
“It is a big priority for me to educate my son about the world, but always to stay connected to his Malawian culture,” she said. “He has a big map of Africa in his room with lots of arrows pointing to Malawi.”
The 50-year-old singer is single after divorcing Guy Ritchie last year. As of late, she’s been making the scene with 22-year-old Jesus Luz.

I seem to remember something about Malawian adoption regulations giving a higher priority to married couples as opposed to single parents. It?s not unusual - many countries do that with foreign adoptions. My guess is that Madonna will probably get her way, just like she did with David Banda. And, surprise, surprise, she might get some more attention! But I?m sure that?s not why she?s doing it, right?
