Madame Performative Privacy is back, snake fam. Taylor Swift and Joe Alwyn were spotted by a paparazzo – one would assume – going on a hike in Malibu. I thought she was spending so much time undercover in London with Joe, doing Sunday roasts with the Alwyn family and only going out with various wigs? Guess not. I thought she was SO off-grid with him that she completely forgets to even hang out with her girl squad? Well, that one might be true? You can see the photos here at E! News:

I absolutely loathe stories about copyrights and copyright lawsuits. On one side, most of the lawsuits are pretty junky and they deserve to be thrown out. On the other side, when there is a rare valid copyright dispute, it takes forever to actually come to any kind of conclusion. On a gossip level, it?s like watching paint dry. Taylor Swift has been involved with an unknown number of copyright disputes, some lawsuits or copyright-infringement notices which she served to people in which she claimed were copying her lyrics or music. She?s also been accused of infringing on other artists? copyrights. Songwriters Sean Hall and Nathan Butler sued her last year because they claimed her song lyrics in ?Shake It Off? infringed on their lyrical copyright from the song ?Playas Gon? Play.? Hall and Butler did not win their suit, but at least the whole incident did provide us with some excellent judge-shade.
Judge Michael W. Fitzgerald has dismissed a copyright lawsuit against Taylor Swift for her 1989 track, ?Shake It Off?. In his ruling, Judge Fitzgerald delivered pointed criticism about the song while ruling that the lyrics she allegedly stole from the 3LW?s 2001 hit ?Playas Gon? Play? were too ?banal? to be entitled to protection. Songwriters Sean Hall and Nathan Butler sued Swift last year, claiming her song stole their lyrics, ?Playas, they gonna play/ And haters, they gonna hate.? On the chorus of ?Shake It Off?, Swift sings, ?Cause the players gonna play, play, play, play, play/ And the haters gonna hate, hate, hate, hate, hate (haters gonna hate).?
Although short phrases are historically immune from copyright claims, Hall and Butler argued that their lyrics were ?sufficiently creative? enough to warrant protection. Judge Fitzgerald disagreed, ruling that ?the allegedly infringed lyrics are short phrases that lack the modicum of originality and creativity required for copyright protection.? He added that ?players, haters, and player haters? were already ingrained in American pop culture by 2001.
Here?s the specific quote from Fitzgerald?s ruling: ?In the early 2000s, popular culture was adequately suffused with the concepts of players and haters to render the phrases ?playas? gonna play? or ?haters? gonna hate?, standing on their own, no more creative than ?runners gonna run?; ?drummers gonna drum?; or ?swimmers gonna swim.? The concept of actors acting in accordance with their essential nature is not at all creative; it is banal. The allegedly infringed lyrics are short phrases that lack the modicum of originality and creativity required for copyright protection.?

?Banal? is a great word. We should use it more, because so much of pop culture is banal. Taylor Swift is lyrically banal. This lawsuit was a legal banality. But the whole thing has probably given Taylor some more ?ideas? for future lyrics: swimmers gonna swim, drummers gonna drum, idiots gonna idiot, smarmers gonna smarm, lovers gonna love, geese gonna fly, and on and on.

Don?t get me wrong, I actually have some begrudging respect for the fact that Taylor Swift has changed some of her patterns. Months ago, I said (and many others said) that Taylor would promote Reputation by doing dishy tell-all interviews and stepping out for photo-ops with Joe Alwyn. That hasn?t happened, so I like the fact that Taylor is keeping us guessing. That being said, some of what we all predicted has come true. In many ways, Taylor will never change and whoever she?s with will always need to be promoted as El Uno, The One. Conveniently, those promotions come just days before Reputation drops!
Taylor Swift and Joe Alwyn?s low-key romance continues to heat up.
?It?s a great relationship that everyone hopes will last. Joe could definitely be the one,? a Swift insider says of the singer and her actor beau.
?Their relationship is very different from Taylor?s past ones,? adds the insider. ?They much prefer having dinner parties at home with friends than going out. Just like Taylor, Joe is a homebody. He loves being an actor but doesn?t like the celebrity part of it. It?s pretty special to find someone you?re on the same page with.?
Neither Swift nor Alwyn have spoken publicly about their romance. But at least three songs the Grammy winner?s new album Reputation ? ?Gorgeous,? ?Call It What You Want,? and ??Ready For It?? ? details their private life together. During the bridge of the heartfelt ?Call It What You Want,? Swift sings: ?I want to wear his initial on a chain ?round my neck / Not because he owns me, but ?cause he really knows me / Which is more than they can say.?

Taylor Swift is still everywhere, but I appreciate the fact that she let her second single drop without a lot of back-and-forth from ?unnamed sources? to various outlets. It probably helps that her second single, ?…Ready For It?? is not about Kanye West or Kim Kardashian. It probably helps that RFI is actually a better song than ?Look What You Made Me Do.? Hilariously, Vulture?s music critic Frank Guan points out there are significant similarities between Taylor?s RFI and? Kanye West?s Yeezus. Which is amazing. And if RFI seems more radio-friendly and just, like, a better song, it?s because it was produced by super-producers Max Martin, Ali Payami and Shellback. It also seems like Taylor was also homage-ing the crap out of Sleigh Bells.
Many of you have been analyzing the lyrics and wondering which current or former boyfriend she?s singing about. Some said Harry Styles, some said Joe Alwyn, but am I the only who wondered if this was the long-awaited song about poor Conor Kennedy, the high schooler that Taylor had to sign out of prep school so they could go on dates? But in reality, Taylor wants us to know that it?s about Joe. She?s been ?liking? theories on Tumblr about how this song is about Joe. So now you know.
Meanwhile, Taylor is maybe-probably going to perform at the College Football National Championship in Atlanta, Georgia?
Taylor Swift is gearing up for a huge performance. A source tells ET that the 27-year-old singer will be performing at the College Football National Championship in Atlanta, Georgia, which is set to take place on Jan. 8, 2018.
?She will headline a concert in Centennial Olympic Park during halftime of the game,” the source says. “It will be a free concert. ESPN has her booked for the event and has a massive deal to release new music from [her upcoming album] Reputation through its college football coverage this season.”
According to the source, Swift can’t perform at the Super Bowl halftime because she has an endorsement deal with Coke, and the Super Bowl is sponsored by Pepsi.
“Taylor’s sponsors (UPS and AT&T) are two of the biggest NCAA Football advertisers on ESPN,” the source notes. However, ESPN tell ET that reports of Swift performing at the College Football Playoff National Championship are “inaccurate.”
“We are pleased that Taylor chose ESPN and ABC?s college football coverage as a platform to debut her new song ‘…Ready For It?’ however, there is nothing more to announce at this time,” ESPN said in a statement.

I think the back-and-forth between ET and ESPN is really just about how far away this is – I mean, January is months from now, and hopefully many indictments and impeachments from now. I don?t know what I?m going to be doing in January (Golden Globes/impeachment coverage?), but this sounds more like a ?sure, I?d love to perform there but I?ll wait to give you a hard confirmation when the date is closer.?

Here are some photos of Taylor Swift over the weekend in Martha?s Vineyard. She was all dressed up because she was her best friend?s bridesmaid! Her BFF is Abigail Anderson, and Abigail got married at the Old Whaling Church in Edgartown. All of Abigail?s bridesmaids wore the same rich maroon color, although from the way Taylor was taking special care of the wedding dress train, I kind of wonder if Tay was the maid of honor?

Taylor Swift can stick to a narrative, even when that narrative she has created blows up in her face. Taylor has already decided that the narrative of her relationship with Joe Alwyn is going to be ?private, low-key.? The narrative is that Big Bad Tom Hiddleston was a terrible famewhore and she learned so much about what she does not want from her relationships. The narrative is that Taylor is just a simple girl who wants low-key love, and she will not parade around with her secret and private boyfriend. The problem with this narrative is that narratives need to be sold for them to work, which is why we have been inundated with stories from People Magazine, Us Weekly, E! News and The Sun about how Taylor Swift is so private now. If you have to tell every media outlet that you?re Super-Private and Low-Key with Your Secret Boyfriend, guess what? You?re not. But at least this time around, we don?t have to hear about swan pastries and fudge. Small mercies.
Taylor Swift is sharing a piece of her heart with Joe Alwyn. After secretly dating for several months, the pop star recently took her relationship with the budding British actor to a slightly more public platform by way of her cherished Nashville hometown. As photographers caught the lovebirds enjoying coffee and chatting on a balcony in Tennessee on Saturday, E! News has learned it was one of the many activities Taylor and Joe partook in during their “low-key” weekend getaway.
The duo spent time at Taylor’s mom, Andrea Swift’s, home, gathering close friends and family members for a small dinner party on Sunday evening. One source tells E! News, “Food was served and everyone hung out together for several hours.”
“Taylor and Joe headed back to her place later in the evening,” the source reveals. Additionally, we’re told Taylor and Joe ordered delivery and invited a few pals over to hang out. “Taylor wants to keep this relationship private and has been taking measures to keep things low-key and under-the-radar,” a separate source explains.
