These are new photos of Halle Berry out in LA yesterday. I hate that I?m in love with that sweater and that purse. God, those are beautiful. Anyway, Halle had lunch with a friend, and she got absolutely swarmed by paparazzi as she was leaving the restaurant. It was just 24 hours ago that her Ebony interview hit the media in a big way - including Halle?s revelation that she believes in the ?one drop? theory, which basically means that we?re all black, I think. She was probably also swarmed because although her ?team? has been leaking damaging information about Gabriel Aubry, Halle has yet to sit down and issue some kind of direct statement to the media about the custody battle. She just gets her rep to do the dirty work, or does it herself as an unnamed source. Even in that Ebony article, Halle didn?t talk directly about the custody battle, although I think she was alluding to it specifically when she talked about race.
I was glancing through this week?s tabloid covers, and I was shocked to see that Halle doesn?t take the full cover on any of them! It’s like the Mel Gibson-Oksana drama all over again - when the tabloids have a truly compelling and controversial drama in real time, they don’t know how to handle it. That being said, Halle takes the sidebar on many tabloids. Us Weekly has ?Halle?s Twisted Secrets? while In Touch Weekly goes with ?Halle?s Dark Secrets? (racist!). Star goes for the more direct ?Halle?s SMEAR CAMPAIGN against Gabriel & Kim?. Nobody has released anything yet, but I?m sure there will be lots of drama in the days to come.

Halle Berry is the March cover lady for Ebony Magazine, in what I?m assuming was a photo shoot and interview done before the current custody battle exploded. That being said, Halle does make reference to a few things that have come up in the back-and-forth in the media, notably that Halle considers her mixed race daughter black. She tells the magazine:
?I feel like she?s black. I?m black and I?m her mother and I believe in the one-drop theory. I?m not going to put a label on it. I had to decide for myself and that?s what she?s going to have to decide ? how she identifies herself in the world. And I think, largely, that will be based on how the world identifies her. That?s how I identified myself. But I feel like she?s black.?

Eh. I know a lot of you are going to fight about it, and that?s okay, I guess. I?m mixed race - I?m half-white, half-Indian - and I?ve always felt that mixed-race people can self-identify however they want. I identify myself as mixed race, at times feeling more Indian or Asian, and at times feeling more like a Southern white girl. It depends, but no matter what Halle says, Nahla will make the decision for herself as to how she identifies when she gets older. TMZ has another story claiming that Gabriel Aubry would ?go nuts? if someone suggested that Nahla was black - according to sources, Gabriel ?insists? that Nahla is white. I have to say, I think in this particular insistence, it?s less about race and more about Halle attempting to negate Gabriel?s biological contributions, you know? Gabe is white - when Halle insists that Nahla is black, it?s like Halle is cutting Gabe out.

Halle Berry put aside her bitter custody battle with baby daddy, Gabriel Aubry, as she gushed about the wonders of motherhood in the March issue of EBONY Magazine, RadarOnline.com has learned.
“Being a mother is probably the most important thing in my life right now,” Halle, 44, revealed in an interview with EBONY Editor-in-Chief Amy DuBois Barnett, when asked what motivates her to continually challenge herself in every aspect of her life.
“Career is important, but nothing really supersedes my roles as a mother. That’s the most important thing I’m going to do in this life at this point,” said the Monster’s Ball actress.
Halle and Gabriel are currently embroiled in a heated custody battle over their two-and-a-half-year-old daughter, Nahla. As RadarOnline.com exclusively reported the relationship between the ex-couple has deteriorated so much over the past week that they are no longer even on speaking terms.
“If Gabriel needs to find out anything about Nahla he goes through the nanny now,” a source told RadarOnline.com. “He and Halle are no longer speaking directly to each other.
“There were still talking, albeit limitedly, up until a week or so ago, but now - nothing.”
The source added Gabriel is concerned that Halle will request that all his visits with their daughter be supervised after various reports have claimed that Aubrey used the ‘N’ word in describing Halle. One source close to Aubrey strongly denies that.
The March issue of EBONY Magazine will be released nationwide February 8.

In the Ebony piece (which I?m now convinced will be one of Ebony?s best-selling issues), Halle also talks about dating - specifically, dating white men: ?Well, first thing I want to say is that I?m very connected to my community and I want black people to know that I haven?t abandoned them because I?ve had a child with a man outside of my race and I?m dating someone now outside of my race who is Spanish and French?I have never been more clear about who I am as a black woman. The people I have dated sort of hold up a mirror to me and help me realize more of who I really am.? Wait? what? So dating white dudes has made her even more ?clear? about being black? Sure.

I was all prepared to begin writing about Gabriel Aubry?s new public statement (via his rep) when I saw that this custodial drama between Halle Berry and Gabriel had taken the cover of this week?s People Magazine (see the cover here). Since it seems these two jags are bound and determined to fight this entire thing in the public sphere, I am only going to continue my non-committal attitude towards taking sides. I know many of you have already picked your side - that?s fine. I think they are both behaving inappropriately, and the accusations that are currently flying around are immature and nasty. Okay, first up: Gabe?s latest defense, via his rep to Us Weekly:

There were clues that something was amiss when Halle Berry’s ex-boyfriend Gabriel Aubry took legal action to establish custody rights of their two-year old daughter Nahla back in December, but now their facade of amicability has been completely shattered. Radar Online says:
Halle, 44, released a statement claiming that she has “serious concerns for her daughter’s well-being while in the care of her father for any extended period of time and is prepared to take all necessary steps to protect her.”
Gabriel, 35, is ready to fight and will seek sole custody of Nahla — [he] has already consulted attorneys in both California and Canada.
“Halle has gone too far this time,” the source [says]. “Attacking Gabriel and accusing him of being an unfit father is totally below the belt and completely without merit. He’s going to give as good as he gets. There’s no way he is going to allow Halle to take his daughter away from him.”
“He has all kind of weapons that he can, and will, use — some really embarrassing emails and voicemails from Halle that [she would not want] made public — things that really will show her true side and how manipulative, controlling, mean and self-obsessed she can be.”
I think Mr. Aubry has grossly overestimated the sway those voicemails and emails will have on her adoring public. No piece of evidence that he has could be more personally damning than “Catwoman” or “Swordfish,” and they still gave her an Oscar after that.

They began amicably, but now Halle Berry and Gabriel Aubry are getting nasty in their custody battle over daughter Nahla.
According to Radar, the 35-year-old male model has hired lawyers in both California and Canada in his bid to gain sole custody of the youngster.
And after Ms. Berry?s remarks about ?having serious concerns for her daughter?s well-being while in the care of her father for any extended period of time,? Gabriel is irate.
An insider told press, "Halle has gone too far this time. Attacking Gabriel and accusing him of being an unfit father is totally below the belt and completely without merit. He's going to give as good as he gets. There's no way he is going to allow Halle to take his daughter away from him."

As I wrote this morning, the custody battle for Nahla Aubry is heating up, with Halle Berry issuing a series of harsh remarks through her representative, to People Magazine. Now comes the tabloid factor - TMZ and Radar both have reports on the looming Halle-versus-Gabriel court battle. First, TMZ?s piece:
Halle Berry and Gabriel Aubry have been locked in conflict over custody of 2-year-old Nahla for months … and much of it centers around Halle’s movie career.
Sources familiar with the case tell TMZ … Aubry has complained when Halle leaves town it interferes with his ability to be a father. Accommodations were made for Gabriel to accompany Halle and Nahla to London last August after he complained.
Sources say the couple has never gone to court to establish custody and visitation rights. They have tried working it out between themselves, but the situation has now become impossible.
TMZ broke the story … Gabriel filed for paternity last month. Officially we’re being told it was a formality. In fact, it was a prelude to what has become a bitter custody fight.

TMZ?s report actually seems like it could have come from either camp, which makes me suspect that it?s somewhat accurate. Gabriel memorably tagged along with Halle to South Africa, where she filmed a movie last summer with Olivier Martinez, who quickly became her lover. Gabriel seems perfectly willing to drop everything to follow Halle and Nahla, although I could understand why Gabriel is seeking a more structured and formal custodial arrangement. What doesn?t help matters, however, is that Gabriel or some member of Team Aubry keeps leaking really vicious stuff to Radar:

The source says that Candadian-born Gabriel has already consulted attorneys in both California and Canada, as Nahla has dual citizenship, and will actively be pursuing sole custody — something that was never his intention
“Halle has gone too far this time,” the source tells RadarOnline.com. “Attacking Gabriel and accusing him of being an unfit father is totally below the belt and completely without merit. He’s going to give as good as he gets. There’s no way he is going to allow Halle to take his daughter away from him.”
Some of the weapons Gabriel is prepared to use in the battle include voicemails and emails from Halle ? messages that do not show her in a flattering way. The messages show a mean and controlling side of Berry, according to the source, and there?s no way she would want the made public.
As RadarOnline.com previously reported, Gabriel felt forced to take legal action back in December to establish his custody rights following a series of explosive outbursts by Berry.
Gabriel’s intention at the time was purely to gain the right to joint custody — believing that despite his personal problems with Halle that she was, overall, a good mother.
But, according to the source, Halle’s latest actions have changed his mind on that front.
“It’s obvious to Gabriel that Halle is using their daughter to get to him, and there’s no way on Earth he is going to allow that to happen. He is going to do all in his power to keep Nahla in his life — whatever that entails. Gabriel believes he can provide Nahla with a much more stable, consistent home life than Halle. He is willing to totally put his career on hold to care for her, whereas Halle is constantly traveling around the world and working on film sets. If she wants to fight dirty he has all kind of weapons in his arsenal that he can, and will, use. Gabriel has some really embarrassing emails and voicemails from Halle that there is no way she would want being made public — things that really will show her true side and how manipulative, controlling, mean and self-obsessed she can be.?
“If he is forced to he will go all out to make sure the truth is known and that ultimately his daughter is protected and properly cared for,” the source said.
As RadarOnline.com previously reported, Gabriel has believed for some time that Halle has hired a PI to trail him, something, the source says, makes perfect sense in light of Halle’s latest comments.
“She’s obviously trying to build a case that Gabriel is an unfit father, and good luck with that! This guy is one of the most down to Earth, regular, bordering on boring men I know. She’ll really have to go some to dig up even a parking ticket. He’s as clean cut as they come.”
Meantime, the source says that Halle is pushing hard to try to get a hearing at family court before the end of the week — something she has, so far, had no joy achieving.

Ugh. As I said before, I still think that Gabriel and Halle are probably very good parents. The problem is that they?re BOTH so friggin? immature. Yesterday, I was feeling the 50-50 split for assigning blame between the two of them, but now I?m sliding slightly in favor of Gabriel, just because I do think Halle was being unnecessarily harsh when she called into question Gabriel?s ability to be a good father to Nahla. So now I?m basically thinking: Halle gets 55% of the blame for being childish and immature, and Gabriel gets 45% of the blame.

A couple of weeks ago, Radar published a particularly vicious anti-Halle Berry report. The sourcing was odd - the quotes either came from Gabriel Aubry or someone directly involved with Gabriel?s business, and the ?source? made Halle sound like a vindictive, controlling, and completely crazy bitch. And it made Gabriel sound like the poor little innocent victim, caught up in Hurricane Halle?s path of destruction. I thought at the time that the report could an opening salvo in what was looking like a full-blown custody war between Halle and Gabriel - all to see who gets custody of their daughter, Nahla. Late Monday, People Magazine had a report where the sourcing was very clear - everything is coming from Halle?s rep. And it?s in People! Meaning: This is Halle?s official version of what?s going down as far as custody. Apparently, Halle is very close to asking the courts to give her sole custody of Nahla because, in the words of Halle?s rep, ?Halle has serious concerns for her daughter’s well-being while in the care of her father for any extended period of time and is prepared to take all necessary steps to protect her.? Day-um.

To clear her schedule for custody litigation, Berry, 44, pulled out of the film New Year’s Eve, set to start filming this week in New York. She’s being replaced by Katherine Heigl.
“She has attempted to resolve these custody issues amicably with her daughter’s father, Gabriel Aubry, directly, but given his lack of cooperation, Halle has no choice but to seek swift judicial intervention,” her rep says.
Aubrey, 35, filed court papers Dec. 30 seeking to be formally recognized as Nahla’s father and to establish that he’ll share custody. The couple split last April.
There was no word on what prompted the custody dispute.
Berry’s rep says, “Halle has always made the needs and safety of her daughter her first priority and, both while Halle and Gabriel were a couple and since their break-up, Halle has only acted in her daughter’s best interest.”

I wondered if this was going to get dirty. A lot of you yelled at me, back in the day, when I questioned the back-and-forth from Camp Aubry and Camp Berry in the tabloids, and what that kind of immature bickering would mean long-term for their custodial arrangement for Nahla. Now what seems like a tenuous truce over the past year is completely gone - it is now full-blown war. And I?m not picking sides with these two, either. I think Halle is a nut-job when it comes to men and relationships, but I also think she?s a good mother. I think Gabriel is probably dumb as a box of hair, and his public pity party grates on my nerves. BUT - I also think he cares a lot about Nahla, and really wants to be involved in her life as much as possible. Basically, I think they?re both good parents who are using their daughter?s custody as a way to fight with each other. Both are handling this situation poorly. Just my opinion.

Making for quite the kickoff to a romantic weekend, Halle Berry and Olivier Martinez took their love to the beach in Malibu, CA on Friday (January 28).
The "Dark Tide" co-star couple laughed it up during a lovers' stroll along the Pacific shoreline while taking in the picturesque sunset.
Aside from their blossoming relationship, Miss Berry is gearing up to release her third fragrance Reveal , which hits store shelves next month.
Described as a blend of lumeria, peach vetiver and mimosa notes, Halle said this in a statement: ?Reveal is an invitation for women to share their story, to reveal some parts of themselves that they have not yet expressed. Seeking out the perfect place for her daughter to grow, Halle Berry was out school hunting in Hollywood, California on Wednesday (January 26).
The Oscar winning actress made her way over to ABC Little School for a staff-guided tour of the facility as she decides where to send her little girl, Nahla Aubry.
The outing comes as Miss Berry continues to be courted by Aretha Franklin - who desperately wants Halle to portray her in a movie based on her life.
Relaying the message through Wendy Williams via letter, the Queen of Soul wrote, "Many actors have portrayed vocalists by lip-synching to the artist's original recordings. I would have liked Halle Berry to portray the older Aretha in the upcoming biopic of my life based on my memoir 'Aretha: From These Roots,'"
