In her testimony in her conservatorship case, Britney Spears mentioned that she wasnt even aware that she could petition to have the conservatorship removed. Britney said that her court-appointed lawyer, Sam Ingham, hadnt informed her that she could do that and told her I can?t let the public know anything they did to me. He told me I should keep it to myself. Ingham has not filed to have Britneys conservatorship terminated and legal experts have said that if he did not inform his client of her right to terminate that it was negligent. Ingham has now resigned Britneys lawyer. While some may consider this a positive development for Britney, it may delay her case as Ill get to in a moment. Heres more, from US Weekly. Britneys longterm manager, Larry Rudolph, has also resigned. The co-conservator of her estate, Bessemer Trust, is leaving as well while the conservator of her person, Jodi Montgomery, plans to stay on.

Britney Spears? court-appointed attorney, Samuel Ingham III, is stepping down less than one month after the 39-year-old pop star?s emotional conservatorship hearing, Us Weekly can confirm.

The California-based attorney filed a resignation request with the court on Tuesday, July 6, according to documents obtained by Us. The filing states that Ingham will step back from his role once the judge finds Spears a new court-appointed counsel.

Loeb & Loeb LLP, which is a secondary firm that was brought in to work with Ingham in October 2020, is also resigning. The private firm?s decision to resign from the conservatorship also will take effect once new counsel is approved by the judge.

US Magazine quotes an expert who says that its possible there could be a hearing to determine whether Britney is competent enough to hire her own counsel. I really hope that happens for her and that she gets the right to hire someone representing her interests. This comes right after The New Yorker published Ronan Farrow and Jia Tolentinos explosive report on Britneys conservatorship. That piece details how quickly the conservatorship was established when Britney was going through a crisis as she was losing custody of her children. Britney was being controlled by other men in her orbit, and then her father, Jamie, took over legally. The way Farrow explains it, Jamie emotionally abused Britney while controlling her finances and access to her children. Britney went to great lengths to try to get a cell phone, to attempt to get her own lawyer, and to try to get the word out about what was happening to her. Everyone she befriended and asked for help, including a housekeeper and a photographer, were found out and fired by the team of people controlling her.

I asked my friend Lisa for a quote about this. Shes a cohost of the Eat, Pray, Britney podcast and I spoke to her on episode #82 of our podcast. Lisa thinks that Inghams resignation may delay Britneys case. She said The scary thing is, Britney has no legal right to pick her own attorney and its unclear how she would get ahold of a new lawyer even if she could pick because they are restricting her interactions with people and her phone and internet use.

One thing Farrow covered that struck me is the issue of conservatorships becoming a self-fulfilling loop thats impossible to escape. Everything Britney does is seen under that lens. Farrow quotes a disability rights advocate, Jonathan Martinis, who says that people are screwed under conservatorships, basically, and that the burden of proof is incredibly high. Martinis detailed something that sounds quite similar to a study I learned about in psychology class, the Rosenhan experiment. He said If a conservatee functions well under conservatorship, it can be framed as proof of the arrangement?s necessity; if a conservatee struggles under conservatorship, the same conclusion can be drawn. And if a conservatee gets out, and stumbles into crisis or manipulation?a likelihood increased by time spent formally disempowered?this, too, might reinforce the argument for their prior legal restraints. Britney had a residency in Vegas for four years. What more can she do to earn her freedom, when she hasnt been able to go public with her story for 13 years?

A judge rejects Britney Spears' request to have her dad removed as conservator
Early in Britney Spears? statement in court last week, she told the judge that she didn?t know that her lawyer could file to terminate her conservatorship. The news was somewhat lost in the larger narrative of abuse and the lack of disability and reproductive rights within Britney?s statement. It?s clear that Britney has been deeply unhappy and flat-out traumatized by her conservatorship. But it?s negligence from her lawyer that Britney didn?t even know that she could ask for the whole thing to be terminated. All Britney?s lawyer has asked from the court is that they make changes to the conservatorship. In fact, Britney?s heart-wrenching statement came as part of the ongoing hearing to simply remove Jamie Spears as permanent conservator. One week later, and the judge has denied the request:

A judge has shot down Britney Spears? request to have her father removed from her conservatorship ? at least for now. New court documents that were filed by the Los Angeles Superior Court on Wednesday show that the judge has denied a months-old request by Spears? attorney, Samuel Ingham III, to remove her father, Jamie Spears, as her sole conservator. These documents are not in direct response to last week?s hearing, where Spears gave an explosive testimony; though Spears delivered a powerful 24-minute statement, the judge cannot make any ruling based on what she said as she still has yet to file a petition to terminate her conservatorship.

?The conservator?s request to suspend James P. Spears immediately upon the appointment of Bessemer Trust Company of California as sole conservator of estate is denied without prejudice,? the court documents filed on Wednesday stated.

The new court filings are another legal setback for the singer, but the judge?s denial is nothing new. Samuel Ingham III had filed the request to remove Spears? father back in November 2020, stating that his client was ?afraid of her father? and would refuse to perform again, if her father continued to be in charge of her career. At that time, Judge Brenda Penny declined to suspend her father from the conservatorship, though she did not rule out future petitions for his removal or suspension. Also, at that time, the judge appointed financial company Bessemer Trust as a co-conservator.

Today?s paperwork was solely intended for the judge to approve Bessemer Trust as the co-conservator, but also reiterates the judge?s decision to not remove the elder Spears from the pop star?s conservatorship. However, it?s significant that the document was signed by Judge Penny on June 30 ? after the singer?s explosive testimony where she told the judge that her conservatorship was ?abusive.?

It?s not good news, and it?s basically showcasing the sh-ttiness of the laws around conservatorships, which are seriously lacking in fail-safes for abusive conservators. That being said, Britney needs new lawyers. This ruling didn?t happen because Britney ?doesn?t have a case.? This ruling happened because her lawyer sucks and he?s terrible at his job. Britney needs legal representation with people who know they?re working for her, people who know conservatorship law backwards and forwards, and people who will give Britney a lot of options about how to proceed.

Questions arise about the negligence of Britney Spears' lawyer Samuel D. Ingham
The world is still reeling from Britney Spears? statement in court on Wednesday. We all suspected/knew that Britney?s situation was bad, but she laid out in plain terms just how awful it?s been for years, and just how much she?s been used and abused by her father, by her family and by every single person with any kind of power or authority over her life. Another reason why this was such a big moment in Britney?s life is because it will likely jump-start a new era in how her conservatorship functions and it might even end her conservatorship entirely. The problem is that Britney?s lawyer, Samuel D. Ingham III, has still not filed papers to end the conservatorship. Britney?s statement came during a hearing to remove Jamie Spears as conservator and have him replaced with Jodi Montgomery permanently. It was clear from Britney?s statement that she simply wants to be done with all of this though. So why hasn?t her lawyer filed to get the conservatorship removed? That?s the question other lawyers are asking:

Before Britney Spears broke her public silence on Wednesday regarding the long-running legal arrangement that has controlled her life, calling it abusive in an urgent and emotional speech, the man appointed to represent her in court for the last 13 years said he had no role in what she was about to say.

?These are entirely her words,? said Samuel D. Ingham III, a lawyer for the singer since 2008, when she was deemed incapable by a judge of hiring her own counsel. When Ms. Spears said this week that, under the arrangement, she had been forced to perform, take debilitating medication and remain on birth control, among other claims, she drew attention to the question of whether Mr. Ingham had done enough to educate and support his client, as the law requires.

?I didn?t know I could petition the conservatorship to be ended,? Ms. Spears, 39, told the judge during a live feed of the hearing. ?I?m sorry for my ignorance, but I honestly didn?t know that.? She added, ?My attorney says I can?t ? it?s not good, I can?t let the public know anything they did to me. He told me I should keep it to myself, really,? the singer said.

Mr. Ingham did not respond to requests to comment Thursday on how his client?s portrayal of him in court corresponded with his own view of his counsel, and it is unknown what discussions the two have had about whether or how Ms. Spears could ask to end the conservatorship. But the dramatic courtroom moment illustrated their frayed relationship, and the inherent conflicts that exist in a conservatorship system in which Ms. Spears has been forced to pay a lawyer she did not choose for herself.

?It?s certainly troubling that this has gone on for so long if she has wanted to end it,? said Rebekah Diller, a professor at the Cardozo School of Law and an expert on guardianships. ?It?s hard to know exactly what?s gone on behind closed doors, but in general one would hope she has been told that throughout the years, because it?s a critical right she was entitled to.?

Last year, Mr. Ingham began seeking substantial changes in the conservatorship, including some steps toward Ms. Spears?s requested removal of her father as conservator. And in her remarks, Ms. Spears noted that she and Mr. Ingham had developed a closer relationship of late, speaking about three times per week. Still, Ms. Spears said on Wednesday, she wished to hire her own lawyer. After Ms. Spears?s remarks, Mr. Ingham said he would step aside if asked, but the current judge in the case, Brenda Penny, did not lay out in detail what the next steps would be to address Ms. Spears?s concerns about the conservatorship or her legal representation.

Sarah J. Wentz, a trusts and estate lawyer for Fox Rothschild, said that given what Ms. Spears presented in court, she ?can?t even fathom? why Mr. Ingham had not been prompted to file to terminate the conservatorship. ?If he knew what she was saying, he should have been prepared,? she said. ?If he did what a lawyer is supposed to do, he would have met and found out she wants to terminate.?

My guess is that Ingham knows he?s being paid by Jamie Spears and not, technically, Britney Spears. But still, Ingham has a sworn duty to represent his client and his client?s interests. What he did and didn?t do for Britney is not only negligent, it could conceivably get him disbarred, especially if he failed to inform his client about her fundamental human rights. There is absolutely no reason why Ingham did not file a swarm of legal notices when Britney was like ?they?re forcing me to keep my IUD in? or ?they put me on lithium as punishment for not wanting to do the Vegas residency.? There is no excuse for Britney being so uninformed of her rights.

Britney Spears' court statement: They won't allow me to have my IUD removed
Britney Spears court hearing on her conservatorship happened yesterday. This was the first time in thirteen years Britney was allowed to speak at length to the court about her conservatorship and what it has done to her. Britney was put under the conservatorship in 2008, with her father Jamie Spears acting as conservator. Over the years, Jamie has brought in various people to help him with the business and financial side, but the whole time he?s maintained control of Britney as a person, controlling what doctors she sees, controlling what medical treatment she receives, vetting who she dates and who she hangs out with. It?s been problematic for years, but I think even the people who had been following Britney?s situation this whole time were surprised by what Britney had to say. Being put on lithium as punishment for not wanting to do the Vegas residency: ?So I remember telling my assistant, but y?know what I feel weird if I say no, I feel like they?re gonna come back and be mean to me or punish me or something. Three days later, after I said no to Vegas, my therapist sat me down in a room and said he had a million phone calls about how I was not cooperating in rehearsals, and I haven?t been taking my medication. All this was false. He immediately, the next day, put me on lithium out of nowhere. He took me off my normal meds I?ve been on for five years. And lithium is a very, very strong and completely different medication compared to what I was used to. You can go mentally impaired if you take too much, if you stay on it longer than five months. But he put me on that and I felt drunk. I really couldn?t even take up for myself. I couldn?t even have a conversation with my mom or dad really about anything.

Her dad forced her into a two-week facility: ?I cried on the phone for an hour and he loved every minute of it. The control he had over someone as powerful as me ? he loved the control to hurt his own daughter 100,000%. He loved it. I packed my bags and went to that place. I worked seven days a week, no days off, which in California, the only similar thing to this is called sex trafficking. Making anyone work against their will, taking all their possessions away ? credit card, cash, phone, passport ? and placing them in a home where they work with the people who live with them. They all lived in the house with me, the nurses, the 24-7 security. There was one chef that came there and cooked for me daily during the weekdays. They watched me change every day ? naked ? morning, noon and night. My body ? I had no privacy door for my room.?

Why she?s saying this now: ?And that?s why I?m telling you this again two years later, after I?ve lied and told the whole world ?I?m OK and I?m happy.? It?s a lie. I thought I just maybe if I said that enough maybe I might become happy, because I?ve been in denial. I?ve been in shock. I am traumatized. You know, fake it till you make it. But now I?m telling you the truth, OK? I?m not happy. I can?t sleep. I?m so angry it?s insane. And I?m depressed. I cry every day.

Her lawyer didn?t tell her how to end the conservatorship: ?I want changes, and I want changes going forward. I deserve changes. I was told I have to sit down and be evaluated, again, if I want to end the conservatorship. Ma?am, I didn?t know I could petition the conservatorship to end it. I?m sorry for my ignorance, but I honestly didn?t know that. But honestly, but I don?t think I owe anyone to be evaluated. I?ve done more than enough. I don?t feel like I should even be in room with anyone to offend me by trying to question my capacity of intelligence, whether I need to be in this stupid conservatorship or not. I?ve done more than enough.

Britney Spears will finally get to speak to the court about her conservatorship
There?s been a lot of back-and-forth in the gossip and tabloid media about Britney Spears this year, especially following Framing Britney Spears, which was largely about how people have been terrible to Britney throughout her life. Its hard to tell whether Britney actually wants her conservatorship removed. Perhaps she believes she still needs some kind of structure, especially financially, or perhaps she knows that removing the conservatorship entirely could be a fool?s errand. What she does want right now, this year, is to have her father Jamie Spears removed from the conservatorship entirely, to remove his influence from her life completely. So, here?s the update: Britney will speak to the judge in an upcoming hearing.

After years of silence, Britney Spears will speak to the probate court in June regarding her long-standing legal conservatorship. At a hearing on Tuesday, Los Angeles Superior Court Judge Brenda Penny scheduled a hearing on June 23 to allow Spears to speak on the ?status of the conservatorship.?

Samuel Ingham, the probate attorney appointed to represent Spears in the case, asked the court to set the date ?on an expedited basis,? but did not indicate what Spears would say. Spears has been under the court-approved conservatorship for the last 13 years. She has made it clear that she no long wants her father, Jamie Spears, to act as her conservator.

Last fall, at Ingham?s request, the judge appointed Bessemer Trust to act as co-conservator along with her father. That order has yet to take effect, as the attorneys continue to quibble over the governing language. At the hearing in probate court on Tuesday, the attorneys gave the court updates on various motions and accounting issues

The last we heard about Britney Spears, she was petitioning to have her father permanently replaced as her conservator by Jodi Montgomery, who was appointed a temporary conservator of her person in 2019. Britney hasnt spoken to her father in over a year, but he remains co-conservator of her finances along with Bessamer Trust. Theres been a renewed interest in Britneys 13 year conservatorship due to the NY Times documentary, Framing Britney Spears, which came out in early February. Britney recently posted a video of herself dancing to Aerosmiths Crazy. In her caption, she commented for the first time about the doc. It sounds like Britney is trying to focus on the positive and that shes not ready to view the documentary as it hits too close to home. Heres some of what she wrote and Im excluding the emojis, which you can see on her Instagram.

My life has always been very speculated

watched and judged really my whole life !!! For my sanity I need to dance to @iamstevent every night of my life to feel wild and human and alive !!! I have been exposed my whole life performing in front of people!!! It takes a lot of strength to TRUST the universe with your real vulnerability cause Ive always been so judged insulted and embarrassed by the media and I still am till this day!!!! As the world keeps on turning and life goes on we still remain so fragile and sensitive as people !!! I didnt watch the documentary but from what I did see of it I was embarrassed by the light they put me in I cried for two weeks and well . I still cry sometimes !!!! I do what I can in my own spirituality with myself to try and keep my own joy love and happiness!!!! Every day dancing brings me joy !!! Im not here to be perfect perfect is boring Im here to pass on kindness !!!!

I love to dance and understand why she keeps making videos where shes dancing. Whenever I dance its like the world and all my stress melts away. The caption is strange to me though. While Framing Britney Spears would surely bring up a lot of bad memories for Britney, it would also show her how much support she has. Her past was finally shown under a different, more sympathetic light. So many people saw that and realized that she should no longer be in a conservatorship, and that her kids were used against her as pawns. Instead Britney, or whoever wrote this, is acting like its hurting her that this is even out there.

I checked the comments for this post and a lot of people say Britney doesnt run her social media accounts and theres no chance she wrote this. It would make sense that someone in control of Britneys accounts would try to make it sound like shes hurting and we should just leave her alone. They have such a vested interest in diverting attention away from this story.

My friend Lisa at the Eat, Pray Britney podcast told me that Britney doesnt control her Instagram and that its run by a social media company called Crowdsurf. She also said that the timing of this is very suspicious because details of the conservatorships payments to her father just came out yesterday. She wrote:

I honestly thought it was a good idea Oprah is good at getting celebrities to open up, and we haven?t heard from Britney in a sit-down, long-form interview in many, many years. Now would be the moment for it for both Britney and Oprah. There were even some claims in recent weeks that Britney was all for it and that Oprah was down too. But here?s Us Weekly pouring cold water on all of it:

Not so fast. Britney Spears wants to speak out amid speculation about her life under her conservatorship but she?s not planning on doing a bombshell interview like Prince Harry and Meghan Markle did, sources close to the singer tell Us Weekly exclusively.

?The report about Britney considering a tell-all is greatly exaggerated and essentially giving false hope to the fans who tweeted calls for it after the Harry and Meghan interview,? an insider tells Us of the 39-year-old pop star. ?Britney would like to tell her story and has always wanted to write a memoir, but the conservatorship makes that difficult and it?s not something on her immediate radar, anyway.?

A second source with knowledge of the situation says the Grammy winner wants to have her voice heard, but in another format.

?Britney hasn?t mentioned doing an interview. She wants to speak and could do so on social media with the assistance of [boyfriend Sam Asghari] on his platforms if it got to be this emergency situation for her,? the insider says, noting, ?She doesn?t want to be filtered.?

Fans were excited when reports surfaced earlier this month that Spears was considering a sit-down interview. The Louisiana native has been stuck in a heated legal battle with her father, Jamie Spears, over her conservatorship, which she?s been under since 2008 after suffering a public breakdown amid her divorce from Kevin Federline, with whom she shares sons Preston, 15, and Jayden, 14. Her efforts to be freed from the restrictive terms of her conservatorship sparked the #FreeBritney movement in 2019, which gained traction following the release of the ?Framing Britney Spears? episode of FX and Hulu?s The New York Times Presents series in February.

I get that Britney is probably tired of being filtered and she?s likely worried about probing follow-up questions from an interviewer if she did sit down with someone. Britney has more than earned the right to tell her own story in whatever way she chooses. But I do think someone like Oprah or Gayle King could really help her. I even think someone like Anderson Cooper might be a great interviewer for Britney. They would help create the chronology of events and what?s happened to her with her father and all of it. Whew.

Britney Spears hopes 'she will be finally be freed from the vice-like grip of her father'
The Framing Britney Spears docuseries has introduced/reintroduced so many people to what happened to Britney over the years, and how many people mistreated her or stole from her or failed to protect her. It?s been happening for more than two decades, although Brit?s conservatorship only began following her breakdown in 2007-08. That?s the part which is still screwing her over the legal and financial web of her conservatorship and wanting to wrest control away from her father, Jamie Spears. According to sources, Britney is happy that all of this dirty laundry is being aired on the docuseries, and she ?feels like there is light at the end of a very long, dark tunnel? and hopes that because of all of the support, ?she will be finally be freed from the vice-like grip of her father.? Britney also made some kind of reference to what?s happening on Twitter last night:

Britney Spears hasn't watched 'Framing Britney Spears' but 'she's aware of it'
People have been watching Framing Britney Spears, a docu-series airing on FX and Hulu. It?s about Britney Spears? life and career, before and after her 2007 ?breakdown? and her subsequent conservatorship. There?s been an outpouring of renewed sympathy for Britney and her situation, and it feels like the #FreeBritney movement is stronger than ever. I enjoy the fact that a whole new generation is learning about all of the crazy sh-t that happened to and around Britney circa 2000-03 too, because Justin Timberlake has always been the fking worst. Anyway, people want to know: has Britney been watching the docuseries? She has not. She lived it.

Britney Spears has not seen ?Framing Britney Spears,? but knows about the New York Times documentary that is shining a major spotlight on her conservatorship issues, a source exclusively told Page Six.

?As of Sunday, Britney hadn?t watched the documentary, but she?s aware of it,? the source said. ?She had not seen any of it.?

When asked whether Britney, 39, was not given permission to view the docuseries as part of her legal restrictions, the insider shared that it was the pop star?s own decision not to watch it.

?She?s chosen not to watch it because she?s fed up with the conservatorship,? the source said. ?She feels there is a hole missing in her life because of the conservatorship and that she won?t be able to live a normal life until that?s over. She knows it?s a battle for her whole life.?

In November, Britney?s attorney, Samuel D. Ingham III, claimed in a court hearing that the ?Toxic? singer had become ?afraid? of her father, Jamie Spears, and wanted him removed from her conservatorship. ?She will not perform again if her father is in charge of her career,? he said.

Los Angeles Superior Court Judge Brenda Penny declined to suspend Jamie, 68, from his duties, but stated that she was open to hear arguments for his removal in the future. Bessemer Trust was named as co-conservator.

Jamie told CNN in December that he hadn?t spoken to his daughter in months. ?When a family member needs special care and protection, families need to step up, as I have done for the last 12-plus years, to safeguard, protect and continue to love Britney unconditionally,? he said. ?I have and will continue to provide unwavering love and fierce protection against those with self-serving interests and those who seek to harm her or my family.?

Despite the latest microscopic attention on her ongoing legal issues due to the documentary, a source told Page Six on Monday that Britney is ?happy and lively.? The next court date over the battle for conservatorship is on Feb. 11.

Maybe Framing Britney Spears will change my mind about this, but I do believe that for several years, Britney?s conservatorship was necessary. Reportedly, even in the middle of her breakdown, she was wary of having her father as her conservator (which seems prophetic now). I know that Jamie is only fighting this hard to remain on as conservator because of money, and I?ve felt for some time now that the financial situation around Britney and her father deserves a microscopic examination. But Jamie has also been in poor health for several years now, and he literally abused his grandsons and put Britney?s visitation with her sons in jeopardy. It?s past time for Jamie to be kicked off the conservatorship, and I?m coming around to the idea that the conservatorship just needs to end entirely.
